Public Offer Agreement for the Distance Sale of Goods on the Linen Life Online Store Website
In accordance with Articles 437 and 494 of the Civil Code of the Russian Federation, this document, addressed to individuals, constitutes an irrevocable offer of the Linen Life homewear and textile online store, represented by Sole Proprietor Kristina Sergeevna Utkina (hereinafter — “Seller”), acting under the state registration certificate No. 320695200041267 dated 13.11.2020, to conclude this Public Offer Agreement under the terms and conditions set forth below (hereinafter — “Agreement”).
1. BASIC TERMS
1.1. Seller — Sole Proprietor K.S. Utkina, selling goods remotely via the online store website https://linen-life.ru.
1.2. Buyer — an individual purchasing goods exclusively for personal use, not related to entrepreneurial activities, who concludes the Agreement with the Seller under the conditions of this Offer.
1.3. Offer — this document, which is a public offer of the Seller, including all its annexes.
1.4. Acceptance — full and unconditional acceptance by the Buyer of the terms of the Agreement.
1.5. Goods — goods, products, information on names, assortment and prices of which are published on the online store website https://linen-life.ru.
1.6. Order — a duly completed request of the Buyer to purchase and deliver the Goods to the address specified by the Buyer via the website https://linen-life.ru.
1.7. Delivery — services for delivering Goods to the address specified by the Buyer and handing them over to the Buyer or a person indicated by the Buyer.
1.8. Courier Service — a third party designated by the Seller to deliver Goods to the Buyer.
1.9. Seller’s Website — the official website of the Seller located at https://linen-life.ru. The Seller’s Website provides Buyers with free and round-the-clock access to information necessary for concluding and fulfilling this Agreement and publishes all official documents of the Seller.
2. SUBJECT OF THE AGREEMENT
2.1. The Seller undertakes to sell, and the Buyer undertakes to accept and pay for the Goods at the prices indicated on the relevant page of the Seller’s website on the date of the Order, under the terms of this Offer, the current version of which is published on the Seller’s website. The Agreement is considered concluded from the moment the Seller receives notification of the Buyer’s intention to purchase the Goods in the form of a duly completed Order.
2.2. All informational materials presented on the Seller’s website are not advertisements, are for reference only, and cannot fully convey accurate information about specific properties and characteristics of the Goods, such as color, shape, size, and packaging. If the Buyer has questions regarding the properties and characteristics of the Goods, prior to concluding the Agreement the Buyer has the right to contact the Seller for consultation by the phone number indicated on the website.
3. RIGHTS AND OBLIGATIONS OF THE PARTIES
3.1. Seller undertakes to:

deliver to the Buyer Goods of proper quality, fully consistent with the Order;

provide the Buyer with accurate information about the cost of the Order, delivery terms and procedure;

provide the Buyer with consulting services on the properties and characteristics of Goods listed on the website;
-
keep confidential the Buyer’s information obtained during the ordering process, as well as the content of private e-mail messages, except as required by the laws of the Russian Federation;
-
timely inform the Buyer of the impossibility to deliver the Goods within the timeframe established by the Order;
-
refund in full the amount paid for the Goods in accordance with applicable law.
3.2. Seller has the right to:
-
rely on the completeness, relevance, and accuracy of the information provided by the Buyer necessary for concluding and fulfilling the Agreement;
-
provide the Buyer with information the Seller deems essential for the execution of obligations under the Agreement, by any available communication method, including by phone and/or SMS notifications;
-
refuse to conclude an Agreement with a Buyer in the event of systematic refusals to accept previously ordered Goods.
3.3. Buyer undertakes to:
-
accept Goods that meet the terms of the Agreement and the Order;
-
pay for the Goods in the amount and within the time specified by the Agreement and Order;
-
place the Order independently in one of the ways specified in the Agreement;

review official information related to the provision of Goods;
-
fulfill other obligations defined by this Agreement and its annexes.
3.4. Buyer has the right to:
-
refuse the Goods and payment, and if the Goods have been paid for, demand a refund if the Seller delivered Goods not corresponding to the Order;

in case Goods of improper quality are delivered, demand at their choice:
-
a proportional reduction of the purchase price;
-
free correction of defects in the Goods;
-
a refund, provided the Goods are returned to the Seller;
-
-
exercise other rights granted by the legislation of the Russian Federation.
4. ORDER PLACEMENT
The Buyer may place an Order by filling out the electronic form on the Seller’s Website, by phone, or via social networks and messengers (Instagram, WhatsApp, Telegram, Viber, Facebook Messenger).
The Buyer must provide: full name, delivery address, e-mail, phone number, product details (name, article, type, quantity, price).
The Seller confirms receipt of the Order by a phone call or e-mail.
5. PRICE OF GOODS

The currency of the Agreement is the Russian ruble.

Prices are specified on the Seller’s Website.
-
Payment is made by methods available on the Seller’s Website.

The Seller may change the price unilaterally.

If the price of ordered Goods changes, the Seller must inform the Buyer within 5 working days.

The Buyer may confirm or cancel the Order.
-
The price of already paid Goods cannot be changed.
-
The date of payment is the date the funds are credited to the Seller’s account.
-
Delivery cost is specified on the Seller’s Website or communicated during the Order.
6. DELIVERY AND TRANSFER OF GOODS TO THE BUYER
Delivery is carried out by the Seller or third parties (courier/postal services).
The Goods are transferred to the Buyer or to a person presenting a receipt or other confirming document.
The place of delivery is indicated by the Buyer when placing the Order.
The Buyer must check the integrity of the package upon delivery.
Ownership and risk pass to the Buyer upon signing the delivery note.
7. RETURN PROCEDURE
According to Resolution No. 612 of the Government of the Russian Federation dated 27.09.2007, the Buyer has the right to cancel the Order before receipt.
Return of pajamas, sewing and knitwear of proper quality is not subject to return or exchange under Art. 25 of the Consumer Rights Protection Law.
8. LIABILITY OF THE PARTIES
The Parties are liable under the legislation of the Russian Federation.
The Buyer is responsible for the accuracy of the information provided.
The Seller is not responsible for improper use of the Goods by the Buyer.
9. CLAIMS AND DISPUTES
Disputes are resolved through negotiations.
Claims must be submitted in writing and considered within 30 days.
If disputes cannot be resolved, they are subject to court review at the Seller’s location.
10. OTHER TERMS
By concluding this Agreement, the Buyer consents to the processing of their personal data.
The Seller may disclose personal data only in accordance with the legislation of the Russian Federation.
The Buyer may request deletion of their personal data after the Agreement is fulfilled.
